Trucking Accidents
12% of Fatalities
Although large trucks, like 18 wheeler’s, make up only 4% of the vehicles on the roadways they account for 12% of all motor vehicle fatalities. For years, Texas has claimed more large truck fatality accidents than any other state in the nation. All too often these accidents occur because of the negligence of the truck driver and the carrier that hired them.
Federal Motor Carrier Regulations
The U.S. Department of Transportation has created special rules of the road for commercial truck drivers known as the Federal Motor Carrier Safety Regulations (FMCSR). The state of Texas has its own set of rules for commercial truck drivers, but has also adopted much of the FMCSR.
The FMCSR and Personal Injury Cases
The FMCSR may have an important impact on a personal injury claim involving the liability of a commercial truck driver or the carrier that hired the driver. The FMCSR requires that trucks carry an insurance policy that will provide coverage for trucking accident and bodily injuries with minimum policy limits of between $750,000 and $5,000,000 depending on the type of vehicle and type of cargo.
